Driver qualification file checklist for small fleets
Each driver needs a file with the employment application, a 3-year motor vehicle record from every state that licensed them, a road test certificate or equivalent, an annual MVR and review note, and proof of medical certification (49 CFR 391.51). Keep the file while the driver works for you and 3 years after.

Missing or out-of-date driver files are among the most common findings when FMCSA reviews a small fleet. Here is what 49 CFR 391.51 requires, read from the current eCFR.
What the file must hold
Each carrier keeps a qualification file for each driver it employs (49 CFR 391.51). It must include:
- The driver's employment application (391.21).
- The motor vehicle record from each state licensing authority for the prior 3 years.
- The road test certificate, or the license or certificate accepted as equivalent.
- Each annual motor vehicle record.
- A note of each annual review of the driving record.
- Proof of medical certification, plus any medical variance or Skill Performance Evaluation certificate.
- For drivers who do not need a CDL, a note verifying the medical examiner is on the National Registry.
The 30-day hiring deadlines
- The MVR inquiry to each state that licensed the driver in the past 3 years, placed in the file within 30 days of hire (391.23(a)(1) and (b)).
- The safety performance history investigation of DOT-regulated employers in the past 3 years, also documented within 30 days (391.23(c)).
Drug and alcohol testing and Clearinghouse checks are separate pre-hire steps. More on hiring: hiring drivers for a small fleet.
What you renew every year
At least every 12 months, get each driver's MVR covering the past 12 months and review it. The review note must show who reviewed it and when (391.25). For Ohio drivers, see Ohio driver MVR checks.
Medical certification
For drivers who do not need a CDL, the file holds the medical examiner's certificate or a legible copy. For CDL holders, the carrier uses the CDLIS motor vehicle record from the current licensing state when it shows medical certification status (391.51(b)(6)). Track expiration dates so no driver is dispatched without a current certification.
The separate investigation file
Replies from previous employers go in a driver investigation history file, not the qualification file (391.23(c)). Keep it secure and limit access.
How long to keep it
Keep the file while the driver works for you and for 3 years after (391.51(c)). Annual MVRs, review notes, medical certificates, medical variances and registry notes may be removed 3 years after the date they were made (391.51(d)).

A file checklist
- Signed application on file before the first trip.
- 3-year MVR from each licensing state within 30 days.
- Previous employer checks in the separate investigation file within 30 days.
- Road test certificate or accepted equivalent.
- Medical certification on file, with the expiration date on a calendar.
- Annual MVR and dated, signed review note every 12 months.
- Logs and hours records kept with the right retention too: see ELD rules for small fleets and hours of service for property carriers.

FAQ
What documents go in a driver qualification file?
The employment application, the pre-hire MVR from each state licensing authority, the road test certificate or accepted equivalent, each annual MVR, the annual review note, and proof of medical certification, plus any medical variance (49 CFR 391.51(b)).
How soon after hiring do I need the MVRs?
Within 30 days of the date employment begins, covering the prior 3 years from each state where the driver held a license (391.23(a)(1) and (b)). The safety performance history replies from prior DOT employers have the same 30-day deadline.
Where do previous employer checks go?
In a separate driver investigation history file, not the qualification file (391.23(c)). Drivers have the right to review that information.
How long do I keep a driver qualification file?
While the driver works for you and 3 years after (391.51(c)). Annual MVRs, review notes, medical certificates and registry notes can be removed 3 years after they were made (391.51(d)).
Can the qualification file be part of the personnel file?
Yes. The regulation allows them to be combined (391.51(a)), but many fleets keep the qualification file separate so it is easy to hand over in an audit.
