New Mexico jury awards $47 million over a tanker truck head-on crash

What it means for small fleets

FreightWaves reports a New Mexico jury awarded $47 million against Pilot Thomas Logistics and Maxum Petroleum over a 2022 tanker crash.

What happened

A jury in Tierra Amarilla awarded $47 million to a pickup driver and his mother against Pilot Thomas Logistics and Maxum Petroleum over a 2022 crash near Carlsbad. The plaintiffs' lawyers said the tanker driver was going too fast for the weather. As of Oct. 19, the court docket showed no final judgment or notice of appeal.

Why it matters

Claims against the driver personally were dismissed, and the case went forward against the companies. FreightWaves notes a 2025 ATRI study found that claims of speeding and other pre-crash negligence can significantly increase jury awards.
