FMCSA takes comments on easing the learner permit front-seat rule

What it means for small fleets

FMCSA says it is taking comments through Nov. 27 on PAM Transport's request to let CLP holders who passed the CDL skills test drive without a CDL holder in the front seat.

What happened

FMCSA published a notice on Oct. 27 asking for public comment on PAM Transport's request for a five-year exemption from 49 CFR 383.25(a)(1). That rule requires a commercial learner's permit (CLP) holder to drive with a CDL holder physically present in the front seat. PAM's request covers CLP holders who have passed the CDL skills test but have not yet received their CDL. A CDL holder would stay in the truck, but not necessarily in the passenger seat. PAM estimates 500 to 700 drivers a year would operate under the exemption. Comments are due Nov. 27, 2026, in docket FMCSA-2026-3466.

Why it matters

PAM says drivers who train in a state other than their home state can sit idle until the home state issues the CDL, and the exemption would let them start work sooner, including a paid trip home to get the license. Under the request, PAM would first verify each driver's permit, license, skills test result, endorsements and medical qualification. FMCSA says the notice does not indicate what it will decide. The front-seat requirement stays in place for every carrier unless FMCSA grants an exemption.

What to consider

If you hire newly trained drivers, keep each permit holder paired with a CDL holder in the front seat, and consider sending FMCSA your view by Nov. 27 if the rule affects your hiring. Comment on the Federal Register notice · 49 CFR 383.25 on eCFR
