FMCSA tells carriers to check that their ELD is still on its registered list

What it means for small fleets

FreightWaves reports FMCSA's chief safety officer said the agency has removed more than 100 noncompliant ELDs from its registered list and encouraged carriers to verify that their ELD providers remain on it.

What happened

FMCSA Chief Safety Officer Steve Dowling said on Oct. 28 at the WEX OTR Summit in Jacksonville, Fla., that the agency has removed more than 100 noncompliant ELDs from its registered device list and kept nearly 600 others from being approved, FreightWaves reports. He encouraged carriers to verify that their ELD providers remain on the list and that their systems cannot be improperly manipulated. The same day, Overdrive reports, a Meiborg Inc. driver showed Illinois State Police and an FMCSA investigator in DeKalb, Ill., how one phone call to a registered ELD provider reset his hours in about 10 minutes. In a statement after that meeting, FMCSA said it and its law enforcement partners "will hold violators fully accountable."

Why it matters

Federal rule 49 CFR 395.22(a) says a carrier required to use an ELD must use only one listed on FMCSA's registered ELDs list. When FMCSA revokes a device, its ELD news page gives carriers up to 60 days to switch to a registered ELD, using paper logs or logging software in the meantime. After that deadline, FMCSA says drivers still using a revoked device are cited under 49 CFR 395.8(a)(1) for no record of duty status and placed out of service. Overdrive reports that since April 1, 2026, the CVSA out-of-service criteria include a separate violation for ELD tampering.
